On this day, the above-styled civil action came before this Court upon consideration of Merco Ine.’s Motion for Partial Summary Judgment [Doc. 92], filed February 16, 2016. Defendant filed its response [Doc. *69797] on March 8, 2016., Plaintiff filed its reply [Doc. 98] on March 22, 2016. The Motion is now ripe, for adjudication. For the reasons that follow, the Motion is GRANTED.
