Plaintiffs Ethicon, Inc. (Ethicon) and Inbae Yoon, M.D. have brought this action against defendant United States Surgical Corporation (USSC) alleging infringement of United States Patent No. 4,535,773 (‘773 patent). The patent was issued to Dr. Yoon in 1985 based on an application in which he stated that he was the sole inventor of all the claims in the application. Ethicon has rights to the patent pursuant to a licensing agreement with Dr. Yoon. USSC has denied liability and asserted a variety of counterclaims against Ethicon and Dr. Yoon,…
