The suit was for personal injuries received as a result of being struck by a locomotive engine upon one of the defendant’s tracks. The court overruled a general demurrer to the petition, and this judgment is assigned as error. The allegations of the petition are substantially as follows: The plaintiff boarded a train of the defendant at Yemassee in the State of South Carolina, for the purpose of being transported as a passenger to Savannah, Georgia.
