Warner, Chief Justice.

The plaintiff brought his action against the defendant to recover damages alleged to have been done to him by the running of its train of cars upon its railroad. On the trial of *115the case the jury, under, the charge of the court, found a verdict for $3'50.00. The defendant made a motion for a new trial, on the grounds therein stated, which was overruled, and the defendant excepted.

The following evidence was had upon the trial of the case :
