We will first consider the motion of the defendant in error to dismiss the writ of error. The motion is predicated upon the following grounds: “1st. That on the 30th day of April, 1906, the Missouri State Life Insurance Company, the plaintiff in ■error in the above-stated case, filed its petition-against this defendant in error in the superior court of Fulton County.
