— Affirming.

Isaac Gray, a resident of Caldwell county, as an employee of the W. T. Congleton Company, a corporation, engaged in the construction of. the Princeton-Dawson Highway, in May, 1933, sustained a broken leg white attempting; to board a truck. Gray and the W. T. Congleton Company had accepted, and were working under, the Workmen’s Compensation Act (Ky. Stats., sec. 4880 et seq.). Gray filed an application against the W. T.
