The parties to this suit will be designated here as they were in the trial court. This suit was instituted on the 28th day of March, A. D. 1912. It is alleged in substance:

That the defendants are indebted to the plaintiff for the purchase price of certain real estate mentioned and described in the petition. That on the 28th day of December, A. D. 1910, the defendants entered into a verbal agreement with the plaintiff whereby he was to sell to them certain real estate amounting to 160 acres of land located in Oklahoma county, and that, at the instance and request of said…
