Tbe plaintiff in error, defendant below, will be referred to herein as defendant, and the defendant in error, plaintiff below, as plaintiff.

The facts out of which this case arose arc that defendant was operating an automobile repair and machine shop at Enid, Okla., and the plaintiff placed his automobile in defendant’s shop for repair. After the repair work had been completed the repair bill was fixed at $20 and plaintiff, after some protest tbat it was an excessive charge, wrote a check in payment of the bill and took his automobile out nf the shop.
