This was a criminal prosecution upon an information charging the defendant, Tobias J. Taylor, with feloniously killing Robert Layfield under such circumstances as to constitute the offense of murder in the first degree. It is alleged that the offense was committed in Clark county, Kansas, on June 26, 1885 ; and all the proceedings had with reference to such offense were had in that county.
