The appellant contends that the trial court erred in refusing to discharge him, for the reason that more than three terms of court had elapsed since the indictment was filed.' The grand jury returned the indictment on January 25, 1904. At the next regular term of the court, which was the March term, appellant’s motion to quash the indictment was allowed.
