S., unlawfully and feloniously did steal, take and carry away,” etc.

Defendant was convicted in the district court of the crime of grand larceny. From that conviction he brings this appeal. Several questions are presented and discussed by counsel for appellant.
I. A plea of autrefois acquit, was made, and it is alleged that the court erred in refusing to submit.the issue tendered thereby to a jury. A demurrer to this plea was first filed by the county-attorney, which was overruled.
