MEMORANDUM OPINION

This case comes before the court on Defendants’ Motion to Dismiss or, in the Alternative, for Summary Judgment (doc. 8) and Defendant Oak Grove Resources, LLC’s (“Oak Grove”) Motion to Dismiss (doc. 9), in which the other Defendants join if their motion is denied. 1 The court has reviewed the motions and the parties’ submissions and has made an independent review of its jurisdiction.
