I. INTRODUCTION

Plaintiff Michael Mock (“plaintiff’ or “Mock”) brought this action against defendants the City of Rome (the “City”) and the City of Rome Police Department (“RPD”) (collectively “defendants”) alleg*430ing discrimination under the Uniformed Services Employment and Reemployment Rights Act, 38 U.S.C. § 4311 (“USER-RA”), and New York Military Law section 318.
