MEMORANDUM AND ORDER

The United States brought this action on behalf of the Small Business Administration (SBA) to collect on a personal, unconditional guaranty executed by the defendants, William D. and Joan Frey. The final pretrial conference was held in this matter on February 3, 1988, and the final pretrial order was filed February 29, 1988. The matter is presently before the court on the United States’ motion for summary judgment.
