Defendant Minnie Minor, individually and as administratrix of the Estate of Albert Fonda Minor, deceased, appeals from a judgment in favor of plaintiff Coombs which was rendered in the instant action for money had and received and to declare a trust.

The complaint sets up three causes of action: The first alleges that within two years prior to his death, Albert Fonda Minor became indebted to plaintiff for money had and received for her use and benefit in the sum of $12,100; that defendant, individually and as administratrix has taken said money into her possession and control and is indebted…
