The plaintiff, Harvey S. Barr, as Trustee of the debtor, Daniel H. Overmyer (“the Trustee”), has moved this court, pursuant to Fed.R.Civ.P. 56, which is made applicable to this adversary proceeding by Bankruptcy Rule 7056, for summary judgment on all counts of a complaint filed with this court on or about April 24, 1985 (the “Complaint”).
