Plaintiff appeals the decision of United States Bankruptcy Judge James Garrity.
I. FACTUAL BACKGROUND
Plaintiff-appellant, Painewebber Incorporated (“Painewebber”), is the former employer of Howard Gollomp, the debtor (“Debt- or”). Painewebber v. Gollomp, No. 93-41210, slip op. at 2 (Bankr.S.D.N.Y. Nov. 22, 1995). When Debtor was hired, he received a lump sum of $200,000.00 representing advanced compensation to be earned over a three year period. (Id. at 2-3.)
