The plaintiff was driving a Chevrolet truck in a northerly direction on Highway 101 through the community of Delake, Oregon. The plaintiff ran into a logging truck and loaded trailer which had been parked by the defendant without lights on the right-hand side of the highway facing north. The plaintiff alleges eight different acts of negligence, among others, the parldng of the vehicle upon the highway without lights in violation of statute.
