Introduction

Plaintiffs, Former Employees of Quality Fabricating, Inc., brought this action seeking judicial review of the United States Department of Labor’s (“Labor”) decision denying their eligibility for trade adjustment assistance (“TAA”) benefits under Section 223 of the Trade Act of 1974. 19 U.S.C. § 2273 (2000). Defendant filed a Motion to Dismiss (“Defendant’s Motion”). On April 13, 2004, the court heard oral argument on Defendant’s Motion.
