This case is before us on certified questions from the Court of Civil Appeals at Waco. A reading of the certificate in conjunction with the record accompanying it discloses that originally Mary Jane Grays and Josie Nichols, filed this suit in the District Court of McLennan County, Texas, to recover an alleged 3/98 interest in 140 acres of land in Gregg County, Texas, for an accounting- for oil removed from such land, for partitions, and for a receiver.
