Introduction
Presently before the Court is Plaintiff Board of Trustees, National Shopmen Pension Fund’s (the “Fund”) Motion for Summary Judgment. The Fund is a multiemployer pension plan. The Fund seeks to recover withdrawal liability sums under the Employee Retirement Income Security Act of 1974 (ERISA), as amended by the Multiemployer Pension Plan Amendments Act of 1980 (MPPAA).
