OPINION & ORDER

KINNEARY, District Judge.

This matter is before the Court on cross motions for summary judgment. (Doc. #11; Doc. # 26.) For the reasons discussed below, the Court GRANTS Plain tiffs motion for partial summary judgment and DENIES Defendant’s motion for summary judgment.
