The essential facts of this appeal are rather straightforward. Appellant Winick Corporation (Winick) was a subcontractor on a public works project. The general contractor obtained a “payment bond” from respondent Safeco Insurance Company (Safeco). When the general contractor failed to pay for labor and materials Winick had supplied, it served a “Stop Notice” on the public agency which had contracted for the project.
