Error to Wayne; Mandell, J. Case by Mary Dettloff, administratrix of the estate of Joseph Dettloff, deceased, against Hammond, Standish & Company for the unlawful killing of plaintiff’s intestate. Judgment for plaintiff. Defendant brings error.

Action on the case by plaintiff as admin.stratrix of the estate of her husband, Joseph Dettloff, for damages, under the “death act,” arising out of his death caused by the defendant. On the 7th of July, 1914, plaintiff’s decedent was driving a milk wagon for the Detroit Creamery Company, at a salary of $21 a week. A motor truck belonging to the defendant, and driven by one of its employees, collided with the wagon which Dettloff was driving, capsizing the wagon upon him, and killing him instantly. On July 30, 1914, the plaintiff made some inquiry in writing of the industrial accident board.…
