MEMORANDUM

In this action, the movant, Benjamin J. Guthrie, Clerk of the United States House of Representatives, asks this Court to quash a subpoena duces tecum. The subpoena requests that he produce documents and other evidence relevant to this case which are under his custodianship.1

The facts underlying this decision are not complex, nor are they in dispute. On March 22, 1982,2 this Court issued the sub*41poena in question and it was duly served on the Clerk of the House, as a non-party witness, at his office in the United States Capitol.3 Shortly thereafter, the…
