Appellant Alvin Jones was charged by indictment with the offense of possession of a controlled substance, methamphetamine, in an amount of more than one gram but less than four grams. On July 24,1996, he pleaded not guilty to a jury and, after hearing evidence, the jury found him guilty. At the completion of the punishment stage of the trial, the judge assessed Jones’s punishment at confinement for three and one-half years in the Institutional Division of the Texas Department of Criminal Justice.
