This action is one to recover for the death of a person through the negligence of another. The plaintiff prevailed, and the defendant appeals.

For some time prior to January 7, 1930, the appellant owned the building and operated the Wick hotel therein, at Pittsburg, Kan. The building was located on the southwest corner of the intersection of Broadway and Seventh street.
