WILLIAMS, Justice.
This is a personal injury suit by two paying guests of a hotel, grounded upon the tort of negligence, growing out of the destruction by fire of Hotel Longview. Appellees, R. W. Cosby and Elizabeth D., joined pro forma by her husband, D. M. Wallace, sued to recover damages for injuries received by Cosby and Elizabeth D. Wallace, who were then husband and wife, in jumping from a third-story window of the west wing of the hotel during the progress of the fire.
