This is an action of assumpsit upon a policy of life insurance issued by the defendant company on November 26, 1929, upon the life of Clothilda E. Osche. The insured died March 6, 1932, and proofs of death were duly furnished to the company. The latter, however, refused to pay the claim whereupon plaintiff, a sister of the insured and the beneficiary named in the policy, brought this action.
