Frank O. Cruger, on September 22, 1931, procured from the New York Life Insurance Company, the defendant, a policy of insurance for $2,000 on his life and paid the quarterly premiums due thereon until his death on July 8, 1932. The plaintiff, an assignee of the beneficiary named in the policy, brought this action in assumpsit to recover the face value thereof with interest and, after trial, the jury found a verdict for the plaintiff for the amount of his claim.
