BUFFINGTON, Circuit Judge.

In the court below, the plaintiff, James F. Stewart, a citizen of Pennsylvania, brought suit against the township of Riverside, a corporate citizen of New Jersey, to recover a balance alleged to be due for the construction of a sewerage system for the township under a written contract and for certain extra work in addition. The case virtually involved proofs as to the whole contract, and the taking thereof .occupied two weeks.
