WOOLLEY, Circuit Judge.

This action was instituted by Warren Brothers Company, a corporation of the State of West Virginia, against Atlantic City, a municipal corporation under the law of the State of New Jersey, being chapter 107 of the Laws of 1902, p. 284, relating to and regulating the government of cities. The plaintiff declared upon an assignment of claims for extra work done under a contract purporting to have been made between one Frank S. Lockwood and Atlantic City, and sought to recover thereupon the sum of $60,583.19, with interest from October 17, 1911. During the progress of the…
