This case involves the appeal by the City of Bristol, Tennessee, (the City) from the district court’s granting of partial summary judgment to a group of City fire fighters who claim that the City violated the Fair Labor Standards Act (FLSA). The fire fighters claim that the City violated both section 7 and section 8 of the Fair Labor Standards Act (FLSA) in recomputing the hourly wage rate for the City fire fighters in response to the Supreme Court’s holding that the FLSA’s overtime provisions apply to state and local governments.
