This matter comes before the Court upon motion by plaintiff Video Pipeline, Inc. (“Plaintiff’ or “Video Pipeline”) to dismiss counterclaims asserted by defendant Buena Vista Home Entertainment, Inc. and counterclaim co-plaintiff Miramax Film Corporation (collectively “Defendant” or “BVHE”). Plaintiff Video Pipeline compiles and organizes previews of home video products to home video wholesaler and retailer customers.
