THE COURT.

Upon consideration of this appeal, we hereby adopt as the opinion of this court herein, the following opinion heretofore prepared by Mr. Presiding Justice Conrey for the honorable District Court of Appeal, Second Appellate District, Division One:

“Appellant, with two others, was brought to trial before the court, without a jury, on several charges of grand theft, as stated in counts one, three, four and five of the indictment. At the trial the action was dismissed as to the co- defendants Philips and Glanz, and count five was dismissed. Defendant Fleming was found guilty on counts…
