CRIPPEN, Presiding Judge.

Appellants challenge the trial court order denying their motion to dismiss respondents’ declaratory judgment action for lack of subject matter jurisdiction. We affirm.

FACTS

This case arises from a contract between respondents City of Two Harbors and Rice Lake Contracting Corporation for the construction of improvements to the city’s sewage treatment plant. After completing excavation for the improvements, Rice Lake demanded $2,166,750 above their estimated price, claiming unanticipated expense in performing the work.
