HULBERT, District Judge.
There are two motions by the plaintiff:
1. To take “the testimony of the defendant, by its officers and managing agents to wit, J. G. Enderlin, Secretary and Treasurer, Clement D. McMahon, Foreman, Master Mechanic in charge of East Bing.hamton Roundhouse and other supervising officers and agents having charge of the maintenance, operation and control of the said Roundhouse and the engines contained therein” pursuant to Rule 26 et seq., Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c, at a designated time and place in Brooklyn, New York.
