LEIBELL, District Judge.

On December 26, 1945 the plaintiffs herein filed a complaint against several corporations and a number of individual defendants alleging damages sustained of five and a half million dollars, by reason of an alleged fraudulent conspiracy and breach of a contract. In November of 1945, one of the defendants named herein, William B. Arness, against whom the action has since' been discontinued, made to the plaintiff Wild, a verbal statement of information obtained by Arness during his employment by one of the defendant corporations, the Alloy Research Corporation, which…
