This motion is granted to the extent and on the conditions mentioned at the end of this opinion.

In this ease, in whieh the issue was joined on May 20, 1929, the plaintiff has brought an action under section 33 of the Merchant Marine Act of June 5, 1920 (46 USCA § 688), commonly known as the Jones Act, claiming to have been injured on March 2, 1929, at 2 p. m. on board a vessel of the United States called the Huron, alleged to be owned by the defendant, whilst the vessel was on the high seas off Santo Domingo, when the plaintiff in the course of his duties as fireman in…
