This is an appeal from a dismissal without a hearing of a petition filed pursuant to the Post Conviction Hearing Act, Act of January 25, 1966, P. L. (1965) 1580, .19..P.S,.§1180-1 et seq. (Supp. 1970),

Appellant James Cannon was found guilty of murder in the first degree following trial by. jury and on September 12,1953, sentenced to life imprisonment. The judgment of sentence was affirmed on direct appeal. See 386 Pa. 62, 123 A. 2d 675 (1956). In 1965 appellant filed a petition for a writ of habeas corpus.
