This is an appeal from the District Court of Adair County, in which Barney Girdner was plaintiff, and H. D. Youngman Contractor,' Inc., was defendant. The pla'in- tiff, Barney Girdner, recovered a judgment against the defendant, and from the order denying defendant’s motion for a new trial, it appeals.
The parties will be referred to as they appeared in the trial court.
