This is an action in tort to recover the resulting damage to plaintiff’s cattle caused by the pollution of a stream by the defendants. The appeal -is taken irom a judgment of the district court of Osage county by the plaintiffs in error, who were defendants below. Reference to the parties will hereinafter be made as they appeared in the district court.
