SAVITCH, J. *

This is an appeal from an order of dismissal following the trial court’s sustaining without leave to amend a general demurrer to plaintiffs’ complaint on the ground that the action is barred by the 30-day statute of limitations in section 10400 of the Streets and Highways Code.

The complaint contains in substance the following allegations:

1. The City of Oxnard, a municipal corporation, through its respective officers initiated proceedings under the Municipal Improvement Act of 1913 (Sts. & Hy. Code, § 10000 et seq.) to order the construction of certain works of improvement,…
