This is an action of tort whereby the plaintiff seeks to recover compensation for personal injuries alleged to have been sustained through the negligence of the defendant.

There was evidence tending to show the following facts: The plaintiff, a pedestrian, at a quarter after midnight, *85stopped upon the curb of a sidewalk, looked both to his right and to his left without observing any approaching vehicle, and then started to cross a square inside lines laid out for foot traffic.
