OPINION
PICKARD, Judge.
Worker appeals from the order of a workers’ compensation judge granting summary judgment to Aztec Well Servicing Company. In July 1990, Worker was injured while working on Aztec’s oil rig. Consequently, this ease is governed by NMSA 1978, Sections 52-1-1 to 52-10-1 (Repl.Pamp.1991) (Effective until January 1, 1991). At the time of his injury, Worker was an hourly worker paid by D & D Employment Agency, a payroll company working exclusively for Aztec.
