Arbitration proceeding under C. S., sec. ’7428 et seq. On April 14, 1922, appellant Boise Payette Lumber Company, hereinafter called the “lumber company,” entered into a written contract with one W. H. Estabrook, hereinafter referred to as the “owner,” the then owner of the “Dessie D.,” “Star,” “Morning Star,” and “Midnight” placer mining claims, situate in Boise County, Idaho, whereby a temporary easement for a right of way for railroad purposes was granted the lumber company a,cross said described mining claims.
