Appellant had a written contract with the State Building Commission for doing the mechanical work in connection with the installation of plumbing and heating in the several buildings of the Mississippi Schools for the Deaf and Blind. In the latter part of 1949 the general contractor had almost completed his work and the architect discovered that the appellant was so far behind with his contract that it would be practically impossible for him to complete it within the time allowed him under the contract.
