Error to the District Court of Teller County. Hon. Jas. L. Bussell, Judge. Action by the board of county commissioners of Teller county against Henry Trowbridge, district attorney of the Fourth Judicial District. From a judgment for defendant, plaintiff brings error, and defendant assigns cross-errors. Decision en bane, Mr. Justice Campbell and Mr. Justice Bailey dissent in part.

1. Is the district attorney of the Fourth Judicial District entitled to $4,000.00 as the maximum limit of compensation as such district attorney for the year 1901; or is he entitled to the sum of $3,000.00 as such maximum limit of compensation?
