Wichita County sought a declaratory judgment to test the constitutionality of Section 57, Article 1436-1. Penal Code1 in so far as it allowed additional compensation to tax assessors-collectors in counties of a population of more than 20,000 and *3paid on a salary basis and to recover from the respondent assessor-collector the sum which had theretofore been paid to him under the provisions of this statute.

The Constitutional Amendment, Section 61, Article XVI, originally adopted in 1935 and amenedd in 1948 reads in part as follows:
