The board d*£ commissioners of the county of DeKalb instituted this action to recover of appellant $78, which amount he had previously received from the treasury of that county in payment of services rendered by him as a member" of the county board of review. Appellee sue*606ceeded in obtaining a judgment against him for that amount, from which this appeal is prosecuted. The errors assigned are that the court erred in overruling'the demurrer to the first paragraph of the complaint, and in denying appellant’s motion for a new trial.
